Practiced commercial litigation and business law at Baker & Botts in Austin, Texas (1988-91). Served as Administrative Law Judge for the Texas Railroad Commission in Austin , Texas (1991-92). Practiced business law, product liability and construction defect litigation at Kolts & Nawa in Pasadena, California (1992-1997).
Joined Margolis & Tisman in 1997. Practices primarily labor and employment law. Ms. Toutant has substantial expertise in both litigation and transactional matters. Ms. Toutant’s practice includes the drafting and implementation of employee handbooks, testing and promotional procedures and workplace policies. Ms. Toutant’s litigation experience includes handling cases at the trial and appellate levels of both state and federal courts. She also has substantial experience in wage and hour class action litigation.
Represents employers and management ranging from wrongful termination and employment discrimination lawsuits and arbitrations to preventative counseling and advice. She also represents management at mediations and arbitrations, as well as during governmental audits and investigations into various compliance issues. These include a variety of matters before the California Labor Commissioner, the U.S. Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing and the Employment Development Department, including audits into the alleged misclassification of independent contractors.
